hen a person, or group, is in possession of a piece of land or premises, they are expected to keep it safe at all times. If there is an injury or death suffered by someone present on that premises, the owner then becomes liable. Premises liability law makes sure that someone is held accountable in the event of a catastrophic injury or death on that property.

Unsafe property includes anything on that land, such as parking areas, buildings, and more. When a site is not properly monitored, it can become an area of dangerous criminal activity that may result in someone being seriously injured or murdered.

You may need an experienced premises liability lawyer if you believe that the owner of the property where you or your loved one was injured failed to take precautions to protect your safety on that property.

Unsafe premises conditions may result in:

Negligence that results in an attack on a person because of unsafe conditions is inexcusable. Oftentimes the owner of the property was told beforehand that the area was dangerous and should take steps to make it safer, but did nothing until it was too late.

Fault

Because it is not always easy to determine fault in premises liability, it is important you seek legal representation as soon as possible. States and jurisdictions may have variations of this law, so you need someone who can investigate the laws for you.
In order to prove that the property owner is liable for your own or your loved one’s injuries, the following will need to be proven:

  • The conditions of the property were unsafe and the injury is a direct result of these conditions
  • The condition was known by the property owner or landlord, but did nothing to remedy the problem
  • The property owner should have known that the condition of the property was dangerous since steps to correct the problem to make the area safer would have been taken by a reasonable person

Premises where injuries or death may occur, and have occurred, include:

  • Bars and restaurants
  • Apartment complexes
  • Parking lots
  • Shopping malls
  • ATM kiosks
  • Hotels and motels
