The state of Oklahoma will bring two different legal cases against you if you have been charged with a DUI. You will face both criminal and civil charges.

DUI Criminal Cases

There are three alcohol-related charges that can be brought against you in the state of Oklahoma:

DUI – You will be charged with DUI (Driving Under the Influence of alcohol or drugs) if you have a blood alcohol level (BAC) of .08 or higher, or if you refuse to take a BAC test.

APC – You will be charged with APC (Actual Physical Control) if you are under the influence and are parked on the side of the road. In these cases, you are not driving, but could drive if you wanted to. This charge is effectively the same as a DUI and carries the same penalties.

DWI – You will be charged with DWI (Driving While Impaired) if you have a BAC between .05 and .08. Penalties for DWI convictions are generally about half as severe as those levied for DUI or APC.

DUI Penalties

If you are convicted of a DUI or APC in your criminal case, you will face the following penalties:

  • Fines of up to $1,200
  • Up to one year in jail

If your BAC is above .15, you will be charged with Aggravated DUI, which carries the same penalties as stated above as well as the following:

  • Mandatory in-patient treatment program with one year aftercare
  • 480 hours of community service
  • Installation of ignition interlock on your vehicle

Penalties are more severe for repeat offenders. If you have a prior DUI conviction, you may face a fine of up to $5,000 and up to 10 years in jail, along with the community service, in-patient treatment, and ignition interlock penalties listed above.

DUI Civil Cases

If you are charged with a DUI in Oklahoma, you will also face a civil case to revoke your driver’s license. The Oklahoma Department of Safety (DPS) will revoke your license if you fail or refuse a breath test. The revocation may range from six months to three years, depending on your prior record.

If you have been charged with a DUI, you have 15 days from the date of your arrest to request a DPS hearing to keep your license. If you fail to apply for the hearing within this time period, your license will automatically be suspended 30 days after your arrest.

This case will usually take place before your criminal hearing. If your license gets revoked, it will be reflected on your driving record even if you are later found not guilty on your criminal case. Therefore, your insurance rates and employment record will be affected as if you had been convicted in your criminal case. Furthermore, any alcohol-related infraction entered onto your driving record will remain there for the rest of your life.
