n August of 2010, a Johnson & Johnson subsidiary called DePuy Orthopaedic Inc. issued a massive recall of its ASR™ hip implant devices:

ASR™ XL Acetabular System
ASR™ Hip Resurfacing System

These defective medical devices have been implanted in about 93,000 patients worldwide and have led to hundreds of complaints of early failure and other problems. About one in every eight patients who received the defective DePuy hip implants have needed a second hip replacement surgery within five years, which is more than twice the normal rate. This revision surgery is both costly and risky, potentially leading to dangerous and painful complications.

Delay in Recall Caused More Injuries

Evidence that DePuy knew of significant problems with its ASR hip implants long before the August recall is mounting. Four years after the ASR devices were first available in 2003, the Australian Joint Registry reported problems with the ASR hip implants seven times beginning in 2007. As a result, DePuy took the defective hip implants off the Australian market in December of 2009, but kept them available in the United States.

DePuy even warned American doctors in March 2010 of the ASR system’s high failure percentage, but did not issue the recall until August. This means that thousands of patients received the defective DePuy hip implants well after the company knew they were not safe. This type of negligence is startling, and is sure to be a factor in any product liability lawsuits that result from the DePuy hip implant recall.
